Terms of Service
Effective Date: March 5, 2026
1. Acceptance of Terms
By accessing or using the Dele mobile application and services ("Dele," "we," "our," or "us"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use our services.
2. Eligibility
- You must be at least 18 years old
- You must have legal capacity to enter contracts under Nigerian law
- You must provide accurate registration information
- One account per person (no duplicate accounts)
3. Services Provided
Dele operates a digital platform connecting:
- Riders: Individuals seeking transportation
- Drivers: Independent contractors providing rides
- P2P Payments: Peer-to-peer money transfer services
- News: Civic education and current affairs content
Important: Dele is a technology platform, NOT a transportation carrier. Drivers are independent contractors, not Dele employees.
4. User Accounts
Registration:
- Provide valid phone number, name, email
- Create secure password (min. 8 characters)
- Verify phone via OTP
Account Security:
- You are responsible for account security
- Do not share credentials
- Report unauthorized access immediately
- Dele is not liable for unauthorized use if you fail to secure your account
Account Suspension/Termination:
We may suspend or terminate accounts for:
- Violation of these Terms
- Fraudulent activity
- Abusive behavior toward drivers/riders
- Non-payment
- Legal compliance
5. Ride-Hailing Service
Booking Rides:
- Set pickup and dropoff locations
- Review estimated fare (subject to change based on actual distance/time)
- Wait for driver acceptance
- Track driver in real-time
Fares & Payment:
- Fares calculated based on distance, time, demand (surge pricing may apply)
- Prices shown are estimates (final fare may vary)
- Payment via wallet, credit/debit card, or cash
- Membership discounts apply automatically
- Cancelled rides may incur fees (if driver already en route)
Membership Tiers:
- Free: ₦0/month - Standard rides, standard pricing
- Silver: ₦5,000/month - 15% discount, 2 free rides, priority support
- Gold: ₦15,000/month - 20% discount, 5 free rides, luxury cars, concierge
Rider Conduct:
- Be respectful to drivers
- Arrive at pickup on time
- No smoking, eating, or drinking without driver consent
- No illegal activities
- Maximum passengers: as per vehicle capacity
6. Driver Requirements
To drive on Dele, you must:
- Be at least 21 years old
- Hold valid Nigerian driver's license (min. 2 years)
- Own or lease registered vehicle (passing safety inspection)
- Provide vehicle insurance
- Pass background check
- Complete KYC verification
Driver Earnings:
- Drivers keep 80% of the fare — Dele charges a 20% platform commission
- Weekly payouts to bank account
- Tips go 100% to driver
Driver Conduct:
- Maintain clean, safe vehicle
- Be professional and courteous
- Follow optimal routes (unless rider requests otherwise)
- No solicitation of riders for off-platform services
- Comply with traffic laws
7. P2P Payment Services
Send & Receive Money:
- Transfer funds to other Dele users (phone number lookup)
- Add notes (end-to-end encrypted)
- Transaction limits: ₦500 min, ₦500,000 max per transaction
- Fees: FREE for transfers < ₦10,000, 1% for larger amounts
Wallet Top-Up:
- Bank transfer, card payment (Paystack)
- Top-up fees: 1.5% (payment processor fees)
Withdrawals:
- Bank transfer (processed within 24 hours)
- Withdrawal fees: ₦50 flat fee
Fraud Protection: Transactions are irreversible. Verify recipient details before sending. Dele is not liable for mistaken transfers.
8. Prohibited Activities
You may NOT:
- Use services for illegal purposes
- Impersonate others
- Create multiple accounts
- Reverse engineer the app
- Scrape or data mine
- Harass, threaten, or abuse others
- Use bots or automated systems
- Exploit bugs or vulnerabilities (report them to security@dele.cx)
- Fraudulent refund requests
- Off-platform transactions to avoid fees
9. Intellectual Property
All content, features, and functionality (app design, logos, text, graphics, code) are owned by Dele and protected by copyright, trademark, and other laws. You may NOT:
- Copy, modify, or distribute our content
- Use our trademarks without permission
- Create derivative works
License to You: Limited, non-exclusive, non-transferable license to use the app for personal use.
10. Disclaimers & Limitations of Liability
AS-IS Service: Dele is provided "as is" without warranties of any kind (express or implied), including:
- Availability (we may have downtime)
- Accuracy of maps, fares, ETAs
- Driver quality, safety, or reliability
- Freedom from bugs or errors
No Liability for:
- Driver/rider misconduct
- Accidents or injuries during rides
- Lost or damaged property
- Third-party services (Paystack, Google Maps)
- Indirect, incidental, or consequential damages
Maximum Liability: Total amount paid by you in the 12 months prior to the claim (capped at ₦50,000).
Important: Drivers are independent contractors. Dele is NOT responsible for their actions. Insurance is driver's responsibility.
11. Indemnification
You agree to indemnify and hold Dele harmless from claims arising from:
- Your use of services
- Violation of these Terms
- Violation of laws or third-party rights
- Disputes with other users
12. Dispute Resolution
Governing Law: Laws of the Federal Republic of Nigeria
Dispute Process:
- Contact Support: support@dele.cx (30-day resolution attempt)
- Mediation: If unresolved, binding mediation (Lagos, Nigeria)
- Arbitration: Binding arbitration under Nigerian Arbitration and Conciliation Act
- Court: Last resort (High Court of Lagos State)
No Class Actions: You agree to resolve disputes individually (no class action lawsuits).
13. Modifications to Terms
We may update these Terms at any time. Changes will be:
- Posted here with new effective date
- Notified via in-app message (for material changes)
Continued use after changes = acceptance.
14. Termination
Either party may terminate:
- You: Delete account in Settings (data retained per Privacy Policy)
- Dele: Suspend/terminate for Terms violations (with notice, unless immediate action required)
Upon termination:
- License to use app terminates
- Outstanding balances become immediately due
- Data retention per Privacy Policy
15. Miscellaneous
Entire Agreement: These Terms + Privacy Policy = complete agreement (supersedes prior agreements)
Severability: If any provision is invalid, the rest remains in effect
No Waiver: Failure to enforce a provision doesn't waive our right to enforce later
Assignment: You may not assign your account; we may assign to affiliates or acquirers
Force Majeure: We are not liable for delays/failures due to events beyond our control (natural disasters, strikes, etc.)
